These terms are an agreement between you and SPINATON L.L.C., Rexhep Malaj, Prishtina, Kosovo ("Ocufuse", "we", "us"). They apply when you use Ocufuse, including the iPhone app, the web app and this website. By creating an account or using Ocufuse, you agree to them. If you don't agree, please don't use Ocufuse.
Our Privacy Policy explains how we handle your data, and our Consumer Health Data Privacy Policy covers health data under some US state laws.
Ocufuse is a journal. It helps you take consistent photos, note what happened, and share that record with a clinician if you choose. Any decision about your health should be made with a qualified professional. Read Safety and intended use before you start.
If you do eye exercises in the Practice section, follow your clinician's instructions and stop if you feel discomfort, strain, headache or dizziness.
Practice results are results in the activity, not measurements of your eyes.
The games in the app and on ocufuse.com are for fun and screen breaks. They are not a vision test and do not diagnose or treat any condition, and a score says nothing about the health of your eyes. Ocufuse Plus adds features; it does not add any diagnosis or treatment.
You must be 18 or older and able to make a binding agreement. Ocufuse is not for children.
Use your own account, give accurate details and keep them up to date. You are responsible for keeping your sign-in details secure and for activity in your account. Tell us straight away if you think someone else has accessed it.
When you set up Ocufuse, we ask you to confirm that you are 18 or older, accept these terms and our Privacy Policy, and give your explicit consent for us to store and use your health information. This consent is required, because Ocufuse can't keep your record without it.
Eye photos need a separate consent. You can withdraw it at any time in the app, and withdrawing it deletes your eye photos. The Privacy Policy explains how consent works and how to withdraw it.
You can export your data and delete your account at any time in the app. Deleting your account removes your login, entries, photos and files from our live systems and can't be undone.
Your photos, entries and notes belong to you. You give us permission to store, process and display them only as needed to run Ocufuse for you, for example to show your timeline or build a Doctor Brief. This permission ends when you delete the content or your account, subject to backup timing in the Privacy Policy. We do not use your content for advertising or to train AI models.
Only upload photos of yourself. Don't upload photos of other people without their permission. Only add other people's details, such as your doctors' professional contact details, if you are allowed to.
You agree not to:
We may suspend or close accounts that break these rules, and will tell you why unless the law prevents it.
Ocufuse never contacts anyone for you. When you send a message, export or Doctor Brief, it opens in your own app, such as Messages, Mail, WhatsApp, Phone or the share sheet. You choose what to send and to whom, and those services' terms apply. We are not responsible for whether a message is delivered, read or acted on.
You can use Ocufuse for free. Ocufuse Plus is an optional subscription that unlocks extra features, listed on the Ocufuse Plus page. Health and safety logging, urgent help, eye photos, My doctors, export and account deletion always stay free.
We work to keep Ocufuse available but can't promise it will always be uninterrupted or error free. We may change, add or remove features, in the free plan or in Plus. If a change takes away a main Plus feature during a period you have paid for, you can ask us for a refund for the rest of that period. If we plan to shut Ocufuse down, we will give at least 30 days' notice so you can export your data.
Plans and price. On the web, Ocufuse Plus is available monthly, yearly or as a one-time lifetime purchase, billed by Stripe; prices are in US dollars, and sales tax or VAT is added where it applies. The price, billing period and any taxes are shown before you confirm.
Free trial. On the web, the yearly plan starts with a 7-day free trial and the monthly plan with a 3-day free trial, once per account; Lifetime has no trial. Cancel any time before the trial ends and you pay nothing. If you don't cancel, the subscription starts and the first payment is taken when the trial ends.
Automatic renewal. Subscriptions renew automatically at the end of each period, at the price shown when you subscribed, until you cancel. You can cancel at any time before the renewal date. If we change the price, we will tell you before it applies, and you can cancel before then.
Lifetime. Lifetime is a one-time purchase, not a subscription. It gives Plus on your Ocufuse account for as long as we offer Ocufuse Plus, without further payment. It is tied to your Ocufuse account and can't be transferred.
Cancelling. On the web, go to Settings, then Manage subscription. On iPhone, open the Settings app, tap your name, then Subscriptions. Plus stays on until the end of the period you have paid for, then your account moves to the free plan. Your data is not deleted when you cancel.
Refunds for web subscriptions. Payments for a period that has started are not refunded, except where the law requires it. If something went wrong, such as a double charge or a charge made in error, contact us at hello@ocufuse.com and we will correct it. You can cancel at any time and Plus stays on until the end of the period you paid for. If you live in the EU or UK, you have a 14-day right to withdraw from a web subscription. Because Plus starts straight away, by subscribing you ask us to start it within that period, and if you withdraw we may keep an amount in proportion to the days you used.
Cancelling. Cancel in the web app: Settings, then Manage subscription. Deleting your account does not cancel a subscription, so cancel it first.
You can stop using Ocufuse and delete your account at any time in the web app (Settings > Data & privacy > Delete account). Deleting your account does not cancel a subscription, so cancel it first.
We may suspend or close your account, or stop offering any part of Ocufuse to you, if you seriously or repeatedly break these terms, if we must by law, to protect you, other people or the service (for example against fraud, abuse or security threats), or if you don't use your account for a long time. Where reasonable we will tell you first, explain why, and give you time to export your data; in serious cases (such as illegal activity or a security threat) we may act straight away. If we close an account with a paid subscription for a reason that isn't your fault, we will help you get a refund of the unused part through Apple or Stripe.
Sections that by their nature should continue after your account ends survive, including Your content, Disclaimer of warranties, Limitation of liability, Indemnity and Law and disputes.
To the extent the law allows, Ocufuse is provided "as is" and "as available", without warranties of any kind, express or implied, including that it is fit for a particular purpose, accurate, error-free, secure, always available or that defects will be corrected. Ocufuse is a personal record and practice app; it is not intended to diagnose, treat, cure, monitor or prevent any condition, and we make no promise about any health outcome. Information in the app (including research summaries and guides) is general and may not suit your situation.
Nothing in these terms limits rights you have as a consumer that cannot be limited by contract, such as the legal guarantee that digital content matches its description in the EU and UK. If you are a consumer, you keep all the rights your local consumer law gives you.
To the extent the law allows:
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or any other liability that cannot be excluded or limited by law.
If you use Ocufuse in breach of these terms or the law, or infringe someone else's rights through it (for example by uploading another person's photos or data without permission), you agree to cover the reasonable costs, losses and legal fees that SPINATON L.L.C. reasonably incurs because of a claim by someone else arising from that. This does not apply to the extent the claim was caused by us, and it does not limit rights you have as a consumer that cannot be limited by contract.
These terms are governed by the laws of the Republic of Kosovo, and the courts of Kosovo have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there.
Please contact us first at hello@ocufuse.com; most problems can be solved quickly.
We may update these terms. For material changes we will tell you in the app or by email at least 14 days before they take effect. Continuing to use Ocufuse after that means you accept the new terms.
